In the Civil Rights Cases of 1883, for example, the Court in- vented the "state action" limitation, which asserts that "private" decisions by owners of public accommodations and other commercial businesses to segregate their facilities are insulated from file reach of the Fourteenth Amendment' s guarantee of equal protection under the law. After the Second World War, a judicial climate more hospitable to equal protection claims culminated in the Supreme Court's ruling in Brown V. Broad of Education that racially segregated schools violated the equal protection clause of the Fourteenth Amendment.

Why We Must Fire Bad Teachers

The relative decline of American education at the elementary- and high-school levels has long been a national embarrassment as well as a threat to the nation&39;s future. Once upon a time, American students tested better than any other students in the world. Teaching can be taught, to some degree, but not the way many graduate schools of education do it, with a lot of insipid or marginally relevant theorizing and pedagogy. In any case the research shows that within about five years, you can generally tell who is a good teacher and who is not.
